They claim to “have had to deal with trespassers on their private property, theft of their personal property, people shooting at their houses, people hunting both on and off the easement, and people travelling [sic] at dangerous speeds,” — and once, the shooting of Wilkins’ cat by a passing traveler. Frequent use of the easement has also caused land erosion, which in turn resulted in sediment build-up on neighboring properties; those properties then suffered “washout,” which is a serious concern for future use of the land. Meanwhile, the claimants contend that the Forest Service has done less and less to maintain its easement, despite their many requests for assistance. Wilkins and Stanton eventually sued, and the dispute before the justices Wednesday relates to the timing of that lawsuit. The lower court said, and the U.S. Court of Appeals for the 9th Circuit agreed, that the plaintiffs’ lawsuit was too late as it had been filed after the 12-year statute of limitations had run. The relevant statute is the federal Quiet Title Act, which allows litigants 12 years within which to file their claims. The legal question before the justices is whether that statute of limitations is a “jurisdictional” or a “claims-processing” rule. If the justices say that it is a jurisdictional regulation, then the rule goes to the power of the court to hear the case and the landowners will lose. If, on the other hand, the rule is simply considered a procedural claims-processing rule, Wilkins and Stanton may still have a chance to move ahead with their lawsuit, because the claimants’ lateness could be excused as an equitable remedy. The appellants’ arguments rely in large part on a 2021 SCOTUS decision in Boechler v. Commissioner in which SCOTUS ruled against the Internal Revenue Service that a 30-day time limit in a tax case was not jurisdictional, and was therefore subject to equitable tolling. The dispute before the justices brings up an important question: should SCOTUS follow a modern trend of its own creation that require “jurisdictional” statutes to reflect their nature within their own wording, or should it stick to older precedents involving the Quiet Title Act in particular?

Or least somewhat understandable to a Spain speaker I am fluent in Spanish and Portuguese, and have “competent tourist level” French. I can understand written Italian enough to get by and can sorta follow the subject matter but not the detail when I hear it. And still Romanian is an enigma. But I hear it spoken. Maybe written I’d do better.

    it now seems clear to me that America’s demise will be inaugurated by what has become our country’s pastime: a contested election. In two years from now, both parties will declare themselves the electoral victor, with neither presidential candidate conceding defeat; Thanks Trump! What you saw in 2016 when the dems were sore losers was 2% of what you saw cemented in 2020 as the new sore loser strategy of claiming fraud.

    (To start, I should say that I have not watched the video). Unlike the US, it is not too unusual in China to have military equipment on maneuvers throughout the country or traveling from one part of the country to another. I have not heard anything out of the usual in Chinese language media, but will update if I do.

    Those would actually be useful. They probably won’t do it. It would be great to have real hearings on the origins of covid but I wouldn’t really trust the house to do a good job.

    i certainly dont think an academic religious studies program implies the faculty is religious or in anyway doctrinal. I would expect that at an institution training clergy for ordination, where there is certainly overlap with academic religious studies, but not at secular Universities. A case in point may also be Harvard Divinity School which I think started out as a theological seminary but over the years has transformed into a non denominational center for academic studies. Be that as it may....ive also read misquoting Jesus. Although as of late my biblical interests have been more "returning to my roots" and old testament academics...and in that field i can say safely, that you certainly dont have to be religious or a believer to appreciate bible studies. but the one thing which is absolutly mandatory and necessary in that field is to understand Hebrew. No translation in the world gives one the nuances and melodious sound the original invokes. I imagine the same is true to some degree for NT, so get your greek and hebrew textbooks out and start learning, No English translation could ever truly manage to convey the essence. as Ive said many times, imagine shakespeare translated into some non indo-european language, Korean or Bantu. you may get the story line, macbeth kills the king, but thats about it.

    Sad, but I guess such is the evolution of cinema. I'll always be a theater-going patron, whenever I have time to do so, but I understand why there's a shift of movie content as well as quality of viewing films at home. BTW, they are re-releasing Top Gun 2 for two weeks starting December 2nd. Both for money as well as for Oscar buzz... also it's followed by Avatar 2 (I didn't really like the first one, so... meh).
