Yes, sorry, without all the facts, calling it not nice is kind of harsh.

Perhaps you could settle for 'occasionally racist'?

      Bad legal takes by Copper.

The cemetery is private, not public. I don't know if public accommodation law would apply.

BTW, knowing the folks up in Oberlin, if they really didn't want him in there, they'd just dig him up and sit the body off in the piney woods.

Indeed it does. Just like for the restaurants.

I provided a helpful link above defining public accommodation.

      You were warned.

While distasteful, old habits die hard. This sort of thing is to be expected. It is not indicative of systemic racism and frankly is not a real big deal.

Unless of course you favor the approach of ruining anyone who does not comply.

Why can't we just change the racist rule? Why is this even a discussion?

Doesn't anybody find it the least bit surprising that a cemetery could have this rule in place for decades, and apparently nobody noticed until now?

Actually the page linked does not mention cemeteries

                      It is not helpful

The question is whether it is legal

And of course we would like all the facts before making an accusation of something as not-nice as racism

Did you know that there has been a discussion over the last several centuries about the relative importance of rights to free assembly, freedom of association and racism? Whether these activities are public or private makes a difference.

There is a lot more to it than just screaming racism at people who don't have a racist bone in their body.

But I must say we all recognize virtue whenever someone screams racism.

It doesn't matter. The custom, law, practice, whatever you want to call it, is antediluvian, it's ugly, and it needs to be done away with out of standards of human decency. If it's law, then we need to change the law.

If we're not sufficiently motivated to change the law, then we should just leave things as they are, and face our true colors.

                                So to speak.

And some states allow cemeteries to be defined as public accommodations, others don't. Some say specifically that cemeteries are not public accommodations.

At least that was the case a few years ago.

And some states allow cemeteries to be defined as public accommodations, others don't. Some say specifically that cemeteries are not public accommodations.

At least that was the case a few years ago.

Aside from a attempt at a positivist rationalization of the indefensible, just when might that have been? During the Jim Crow era?

                                        Elbows up!

No, within a few years and currently

Private entities can generally do whatever they want concerning who they associate or don’t associate with.

Historically black universities are an example of this, they can limit enrollment to black students

The Burning Tree club in Maryland is an example of an all-male club, many members of Congress belong to this club

Public entities or those defined as public accommodations cannot decide to restrict their membership in the same way

I’m no expert on this, but I can tell you that this thread is a good example of how there is a lot of ignorance concerning this topic, people just love to shout Jim Crow and racist but in general it is ok for you to associate with whoever you want especially in private.
