    Un-freaking-believable.

A Louisiana cemetery has apologised after refusing to bury a local black police officer because of a decades-old provision allowing only white people.

The Oaklin Springs Cemetery board met on Thursday to change its sales contract after an outcry over the "white human beings" rule.

    I was only joking

After a quick scan I didn't see whether the story tells us whether the cemetery is private or public.

That would, of course, make a difference.

Association is still protected by the constitution.

But in public accommodations there are anti-discrimination rules that may apply.

It's hard to believe the author wouldn't mention this.

Don't keep us in suspense, like the author of the story.

So what is the bad legal take?

I'm still wondering whether this story has something illegal going on, or is it just not-nice?

I mentioned public accommodations because I'm wondering if that applies somehow. Does it? I don't think so, I can't find any reference to it.

The man died and the body is turning green like all other corpses in the god damned cemetery. Didn't management get the memo?

Apparently downplaying racism as not nice and defending it with flimsy legal references is really important.

The cemetery is private, not public. I don't know if public accommodation law would apply.

BTW, knowing the folks up in Oberlin, if they really didn't want him in there, they'd just dig him up and sit the body off in the piney woods.

Yes, sorry, without all the facts, calling it not nice is kind of harsh.

Indeed it does. Just like for the restaurants.

While distasteful, old habits die hard. This sort of thing is to be expected. It is not indicative of systemic racism and frankly is not a real big deal.

Unless of course you favor the approach of ruining anyone who does not comply.

Doesn't anybody find it the least bit surprising that a cemetery could have this rule in place for decades, and apparently nobody noticed until now?
