I agree. In rare cases, the biological sex is ambiguous, but I’d say unless the person is unambiguously female, it needs to compete in male sports.

It really has to be. The whole WHOLE point of having separate sports is because of the physical differences between the biological sexes.
Then where do transgender people fit in? Denying the category is not going to get anyone anywhere; it's a non-option. Some rule's got to be made.
Where do they fit?
Competing as the gender they were born. This problem ain't rocket surgery.

It really has to be. The whole WHOLE point of having separate sports is because of the physical differences between the biological sexes.
Then where do transgender people fit in? Denying the category is not going to get anyone anywhere; it's a non-option. Some rule's got to be made.
There's really only two choices that make sense - either you insist on using the sex at birth, or you create new categories for transgender people. Unfortunately, neither of these options is going to be popular with some transgender people. On the other hand, transgender people insisting on being allowed to compete with other athletes of their declared gender is just going to increase anti-trans feelings amongst the rest of the population, and will ruin a number of sports.

But they could not compete against males of the same weight.

At the point you're talking about, the decision would be made by the parental units, not the child.
I think they call that child abuse.

I don't think we're understanding each other.
I'm suggesting that since the performance differences are largely determined by whether someone was exposed to testosterone at a young age therefore it makes sense to use this as the criteria dividing competitive sports. This is pretty similar to your view of using sex at birth though the criteria might vary for intersex individuals.

THe Civil Rights Act has the authority. WHat's going on here is a reinterpretation of 'gender discrimination' based on what the (conservative!) court did with Bostock. Do remember the author of that decision was Neil Gorsuch.
Biden's order simply tells agencies to update any relevant regs with the Bostock interpretation in mind. The full text is on the WH site.
I'm not sure what effect this EO will have in practice, given Bostock is already law of the land.
