I've never thought Trump was particularly smart, and he's clearly getting worse. He clearly thinks he's a freaking genius, and what he has is a gift for self-promotion. But smart? At this point?
I actually think Trump is incredibly sharp. His memory is noteworthy, and he’s able to think very quickly which results in fun debate or press conference performances.
But indeed his obsession with ratings, winning, rankings, and media coverage has blinded him.

BTW, he can wave the documents around as much as he wants or he can talk about them being secret. Neither is a violation.

True waving it around wouldn’t make him guilty of sharing classified info.
But waving them around makes it clear that he possesses them which is illegal. The timing of the tape (after repeatedly telling the feds he doesn’t have them) establishes willfulness AND obstruction AND lying to the feds. And the confession that he could have declassified it but didn’t undermines his former claims that he had done so.
So yeah, this is enough to put the orange man in orange dress.

Clearly as a legal expert here, I'd imagine this is a decent defense. I mean, if you can't prove a document was there, it would be hard to convict. Then again, like you posted, I don't think this was part of the indictment anyway.

Well, there are multiple reports of Trump brandishing (yeah, that's a good word) a classified document, and it being caught on tape.
If this is the tape, and if this is the document being talked about, it's not in the indictment. Therefore it's irrelevant other than a mens rea argument. This is not evidence.

Contrary to popular belief, most Trump supporters did not in fact vote for him in order to watch him burn the country down. Unfortunately, TDS sufferers are at a place where they will joyfully watch the country burn, as long as Trump is caught in the inferno.
