But do courts have the authority to ‘let it slide’ when the letter of the law is very clear? To be fair, that wasn’t really the question. The question was whether the State Executive had the authority to waive that requirement under the broader auspices of the State of Emergency that most states had enacted for COVID. The short answer is the courts thought so. Whether the courts thought it was appropriate or not wasn’t really the issue.
