In February, the State Department designated Tren de Aragua, as well as the MS-13 gang tied to El Salvador, as foreign terrorist organizations.
Tren de Aragua — which means “train from Aragua” in Spanish — is a loose network that doesn’t operate like the groups typically considered terrorist organizations, such as the Taliban or al-Qaeda, the experts said. Its main leader is Héctor “El Niño” Guerrero, who is at large.
“There’s no ideological cause. Their only objective is money,” said Ronna Rísquez, an investigative journalist and expert on organized crime in Latin America. “If you define terrorism as spreading fear, then sure. But if you compare them to the organizations that the U.S. typically designates as terrorists, there’s a huge gap.”

The U.S. deported more than 250 alleged gang members to El Salvador this weekend, and video posted to social media shows the harsh reception they received in the Central American country.
Salvadoran officials said the detainees included 238 Venezuelans who are members of the Tren de Aragua gang, as well as 23 members of MS-13. They were immediately transferred to a Terrorism Confinement Center, where they are scheduled to stay for at least one year, under an agreement between the U.S. and El Salvador worth $6 million, according to the Associated Press.
What is the Tren de Aragua gang, linked to several crimes in US?“The United States will pay a very low fee for them, but a high one for us,” Salvadoran President Nayib Bukele said in comments on X that accompanied government video of the high-security exchange.
In the footage, shackled prisoners are seen stumbling forward as heavily armed officers push them along.
Detainees’ wrists, ankles and waists are tightly bound, forcing them to shuffle in short, restricted steps. On the tarmac, riot police stand shoulder to shoulder, gripping their batons as helicopters hover overhead, scanning for any disturbances.
Serves them right, I think.

Here’s the thing, I’m willing to let the courts decide on the legality of Trump’s use of the old Foreign Enemy Law, but in general, this is still an 80/20 issue. The public want them out of the country, and so even a legal win by the Democrats on this is a political loss. Not that I believe that should be a determining factor, but there is a cost to this.

But a win by people who believe in the rule of law (not all of us are Democrats) wouldn’t stop them from being deported it would just put a wee bit of due process in there.
Right now there nothing to stop Trump from sending you to a concentration camp in El Salvador. At no point is there any process whatsoever that would allow you to say to any magistrate ‘but I was born in Pennsylvania and I can prove it FFS’.

No way scotus lets the 1802 law be used for immigrants. Neither text, history, nor tradition support it. 7-2 decision is my guess. If it even comes to that.
