Show me the man and I'll show you the crime. What you just posted proves my point.

If there was a crime, and he was charged even if others do the same thing and dont get charged, is that an excuse?

What if people are drink driving? "Hey, I saw three other people leave the bar over the drunk limit. Why dont you let me go?

(I know I know, apples vs. oranges. But the defense that "everybody does it", it is not a very good defense.)

Officer: You know why I pulled you over?

        Me: No.

Officer: You were doing 74 in a 55 zone.

Me: But everyone was going that fast.

        Officer: Ever go fishing?

        Me: Yes...

Officer: Ever catch all the fish?

As cute as that story is, it sort of misses the point, most of which is not legal but political.

        1. Has anyone ever been prosecuted for this crime?
        2. The DA ran on an agenda of targeting Trump - whom she claimed was guilty not only of being an (undefined) crook, but of being white.
        3. As a matter of right/wrong, is it right that you have to go bankrupt to defend yourself in court? If the stakes were smaller, would it be the right thing to take someone's house if he can't pay the fine while he appeals the judgment?

It's not that everybody does it, it's that AFAIK, nobody has ever been prosecuted just this way under this statute, and NOBODY has received a fine such as this.

          Personally, I think it's unconstitutional.

          I guess we'll find out.

If I ran for president you wouldn’t find much. Certainly not hundreds of millions of dollars in fraudulent profits. I doubt I’d find anything newsworthy on you either. Don’t attract the spotlight if you’ve done shady shit. If found, even if it was bill clinton in court today, I don’t have a problem with justice being served.

I’d imagine there have been countless of similar cases prosecuted for such type of fraud and ill gotten gains. Not sure where to search and find that info, though.

New York State Has Issued Nearly 9,800 Felony Charges of Falsifying Business Records Since 2015
Data shows 9,794 cases involving state penal law 175.10, or falsifying business records in the first degree, have been arraigned in both local and superior New York state courts since 2015.

Former President Donald Trump is far from the first person to face felony charges of falsifying business records—New York state has arraigned almost 9,800 cases involving the same charge since 2015, according to available data.

I may be wrong, but my understanding is that no one has been prosecuted for such a case in which there was no loss by any of the lenders. At least that’s what I read.

So, if someone kills someone with a fly swatter and that has never been done before, should the person still be prosecuted?

The bedrock of American law is equal justice. Justice applied inequitably is not justice, is it?

The analogy would be if fly swatter killings were not uncommon, but never prosecuted until now.

There is a first for everything. LOL. Again, if you broke the law and it has not been prosecuted before doesn't make you less guilty.

(I should say that I do not know the details of this cases whether he should have been found guilty of not. But the excuse that nobody else has been prosecuted for this is pretty week in my opinion. I have in the recent past there was a first time prosecution for crypto currency fraud. Claiming that you are innocent because others have been doing crypto currency fraud but not prosecuted........

Kind of like when the IRS prosecutes some high profile celebrity on a tax charge that "everybody is doing".)

Give me a week and intense scrutiny, and a good prosecutor could put you in jail.

And you might well be guilty. Of something.

Probably . But usually prosecutors will try to get the most "bang for buck", targeting someone who will give them the maximum publicity and exposure.

I am guessing that this case may cause others to think again before giving a false value of real estate.

Was that the reason here? No - I am sure it was political, but it may have the consequence of stopping others from doing the same thing.

As I mentioned above, like the IRS going after people. Lets say I knowingly do an illegal tax "write off". Everybody is doing it. Will the IRS come after me (or you) or go after celebrity XX? Even though they did not come after me, I would probably think again before doing the tax write-off

(For example, this just came up)
