Dominion Voting sues Fox for $1.6B

Dominion Voting Systems on Friday filed a $1.6 billion defamation lawsuit against Fox News, arguing the cable news giant falsely claimed in an effort to boost faltering ratings that the voting company had rigged the 2020 election.
It’s the first defamation suit filed against a media outlet by the voting company, which was a target of misleading, false and bizarre claims spread by President Donald Trump and his allies in the aftermath of Trump’s election loss to Joe Biden. Those claims helped spur on rioters who stormed the U.S. Capitol on Jan. 6 in a violent siege that left five people dead, including a police officer. The siege led to Trump’s historic second impeachment.
Dominion argues that Fox News, which amplified inaccurate assertions that Dominion altered votes, “sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process,” according to a copy of the lawsuit obtained by The Associated Press.
“The truth matters. Lies have consequences,” the lawsuit said. “Fox sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process. If this case does not rise to the level of defamation by a broadcaster, then nothing does.”

I would too if I were them. When a state considers their next voting system - is Dominion at the top of the list or radioactive because ( right or wrong) a certain proportion of the population thinks they're in with the illuminati?
Those are real damages. Especially if they did nothing wrong.

As the voting company's lawyers explained in the complaint, the election technology market is difficult to break into and very competitive to succeed in. There are only a handful of major election vendors in the US, and big contracts for election equipment don't come up very often.
"Dominion's contracts and prospects have come under increased pressure in a number of significant markets," Stephen Shackelford, partner at Susman Godfrey and one of Dominion's attorneys on the case against Fox News, told Insider in a Friday press conference.
"We obviously hope that filing this lawsuit and proving our case can help with that, but it is an enormous uphill battle, and we're not going to be able to get all the way there, and we know that, and that's why Fox is on the hook for the massive economic damages they've done to Dominion," he added.

In the months following the 2020 US presidential election, rightwing TV news in America was a wild west, an apparently lawless free-for-all where conspiracy theories about voting machines, ballot-stuffed suitcases and dead Venezuelan leaders were repeated to viewers around the clock.
There seemed to be little consequence for peddling the most outrageous ideas on primetime.
But now, unfortunately for Fox News, One America News Network (OAN), and Newsmax, it turns out that this brave, new world wasn’t free from legal jurisdiction – with the three networks now facing billion-dollar lawsuits as a result of their baseless accusations.
No bias there, nope. Those statements might be true, but, isn't the whole point of a trial to determine their veracity.
Maybe FOX can sue Guardian for defamation, LOL?

Dominion v. Fox trial delayed for settlement talks
A Delaware judge delayed the start of the eagerly anticipated trial on a voting-machine company’s defamation claims against Fox News, an announcement that came as the network is looking for a possible way to settle the case.
Superior Court Judge Eric Davis said late Sunday that he was delaying the start of the trial by one day, moving it from Monday to Tuesday. He didn’t explain the reasons for the move.
Fox has made a late push to settle the dispute with Dominion Voting Systems out of court, people familiar with the situation said Sunday.
Dominion has been seeking $1.6 billion in damages but appears to have softened its claims. An April 14 email from Dominion to Fox, attached to a new Fox legal filing on Sunday, indicated that Dominion wouldn’t present a jury with claims for alleged lost profits. In its original 2021 lawsuit, Dominion sought lost-profits damages of not less than $600 million.
Dominion had no immediate comment on the Fox filing. Both sides declined to comment on the judge’s delay.
If the case isn’t resolved out of court, a jury will decide a once in a generation defamation case that could have broad ramifications for the network and test the contours of modern media law. The proceedings are scheduled to last about six weeks.
