How many people have been fired from their employer for doing just this? The defense doesn’t pass the sniff test to inoculate his employer although it likely passes the legal test.
Nah, this is small potato compared to Pompeo trying to get around the Hatch Act while speaking at the RNC by claiming that he spoke there as an individual rather than as an agent of the State Department. If Pompeo's claim passed the sniff test for you, you should have no issue with this one.

In his case it has already been established that he is only a public figure because he was defamed. Now they are trying to deny him his rights and possibly create a dangerous environment for him, solely based on his views. If that is not the basis for a civil rights suit I don't know what is.
