Though I completely agree with what's been said, I think he has some legal exposure.

The dead one was still moving on the floor when the clerk put two rounds in him.

Yup. You can still feel that you are in imminent danger if the perp is still armed.

Yeah, unless the guy on the floor was still armed. But it looked like he was shooting at the other one.
