First of all, the amendment states, "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, ... who, having previously taken an oath, as a member of Congress... shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.
Good luck proving that, particularly in a court. You know that Teh Donald would take that to court, right?
Secondly, as Jolly said, they WANT it to look like an insurrection because that's an easy lift. Doing in the courts is much, much harder. For the nth time, how many insurrection charges have been filed against the 1/6 idiots? Theater.
