Penalties for Attempted Murder in Virginia
In Virginia, the penalties for an attempted felony are based on the punishment for the felony that the person attempted to commit. This is also true for attempted murder. If convicted, you may face these punishments:
Attempted murder. Attempted first-degree or second-degree murder is a Class 4 felony under Virginia Code § 18.2-26. The punishment can include between 2 and 10 years in prison and a fine not to exceed $100,000.
I think three years for somebody without a criminal record would be sufficient.

Going back to that period, there were a lot of contentious issues in Loudoun County Schools. COVID Policies, a new “Equity Board”, and the desire of the school board to be the first school district to fully embrace trans idealogy with bathroom and locker room policies. This was all while the county was facing problems with their student’s acceptance rate at state universities. Loudoun and Fairfax counties were being discriminated against with a penalty of around a .4 GPA and roughly 200 points on the college boards for acceptance at colleges. So board meetings were getting particularly rowdy. The meeting in June 2021 was the one where they were supposed to vote on trans bathroom policies. The meeting was expected to be… Interesting. The sheriffs department sent extra deputies to the meeting expecting trouble.
Scott Smith’s daughter had been raped by a trans student in the bathroom of their school ~ May 20 or so, roughly 4 weeks before the meeting. During the meeting Scott Ziegler (superintendent) gave a joking little talk about how the whole Republican notion of trans sexual predators was a myth and a red herring. He then stated that he had never heard of any cases anywhere if trans people attacking women in the bathroom. Remember, At this point, the story was not public. People were just objecting based on the idea that trans guys in girls bathrooms was unsafe to the girl. We didn’t even know that something happened a few weeks before. So Ziegler then gives this dog and pony show about trans predators being a red herring and proceeds to ask several board members if they had ever heard of a single instance. The board members reply “of course not”, but several of them look about ready to throw up during this.
Scott Smith, rightfully pissed, tries to yell about his daughter, and one of the Loudoun Love Warriors turns to him and says “Your daughter is a lying little bitch”… Well, here we go.
Buta Buberaj, recognizing Scott Smith from the criminal complaint that she chose not to prosecute against the rapist, warned Sheriff’s deputies about him before the meeting. So as soon as he yells at this woman, you get this..
Now all of a sudden, this plumber is the face of right wing domestic school board terrorism. Loudoun County shuts down public school board meetings, The Justice Department sends out that ridiculous statement, and everything escalates. Scott Smith is now being interviewed by FOX, National Review, NY Post, and more. He is also attacked online and professionally by the usual suspects. This has hardened the poor guy and he’s become the face of the fight locally.
By the way, he’s still facing criminal prosecution for the school board meeting.

Commonwealth’s Attorney. One that’s made it a point of not prosecuting non-violent crime. Like 1st offense rapes in bathrooms…
She also “accidentally” made a mess of the paperwork on the second offense, so the kid is not on a sex offender list.

To be fair to Buta, there were some other officials that pushed for him to not be on the list. The latest theory is that teens placed in the offender registry are more likely to re-offend. More Single Variant Fallacy.

Youngkin pardons Virginia father who was arrested at 2021 school board meeting
Virginia Republican Gov. Glenn Youngkin on Friday pardoned a Loudoun County father who was arrested at a school board meeting in 2021 while seeking answers about his daughter’s sexual assault on school property.
Scott Smith was charged with obstruction of justice and disorderly conduct for his behavior at the meeting, which took place shortly after his 15-year-old daughter was assaulted in her school’s bathroom in Ashburn, Virginia, according to the New York Times. Smith was convicted of both charges in 2021. Smith’s conviction for resisting arrest was later dismissed, and he eventually received a suspended sentence of 10 days in jail, according to CNN affiliate WJLA.
