Nick Sandmann is dangerous, says the ACLU staffer
-
This once-honest, once-upright, defender of free speech has gone, I fear, irretrievably down the crapper.
Now, the ACLU’s Samuel Crankshaw in Kentucky has targeted Transylvania University for admitting Nick Sandmann, who was falsely accused of abusing a Native American activist in front of Lincoln Memorial. Despite various media organizations correcting the story and some settling with Sandmann, some in the media have continued to attack him. Yet, it is far more alarming to see an ACLU official rallying people against a young man whose chief offense appears to be that he is conservative and unapologetic.
Crankshaw went to Facebook to alert people that Sandmann would be attending the college and expressing veiled outrage that the school would admit someone with his opposing views. He warns that this kid is “more dangerous” than figures like Milo Yiannopolous. The “danger” is that a young freshman holds conservative views that are shared by roughly half of this country:
*Does anyone else think it’s a bit of a stain on Transylvania University for accepting Nick Sandman? I’m sure it’s a “both sides” defense, but it’s pretty counter to their mission and another instance of there not actually being equal sides to an issue. I think TU should accept anyone willing to have an open mind and engage in debate, regardless of their views. That’s how we all learn. That’s Transy’s mission…
Having experienced the incredibly high standards Transy requires for admission and then holds its students to, this seems like a slap in the face. I hope some time in a real classroom changes him, but his twitter and public persona suggest otherwise.*
The “both sides” defense used to be the position of the ACLU in fighting for all sides to be given equal opportunities and protections. Moreover Crankshaw labels Sandmann a “provocateur in training with no intention of learning.” Putting aside the provocateur label how would Crankshaw know that Sandmann has “no intention of learning”?
One person responding was Dr. Avery Tompkins, an Assistant Professor and Diversity Scholar at Transylvania University, acknowledged that the university supported diverse viewpoints but promised to closely monitor Sandmann while he is on campus: “If he were to cause problems by being disruptive, trolling, or engaging in unethical behavior of any kind, I would immediately document it (just like I would for any student doing the same thing)…and he would just be putting himself in a position for me to file a conduct report.”
Doing the same thing? What thing? Free speech?

They've been in the crapper for some time now, and this is the final flush.
Liberty for me, but not for thee. Where does this end when even the ACLU has lost its way?

The organization that supported a Nazi march through Skokie, IL (a very, very, Jewish community) in the 1960s has a staffer who says a college freshman's speech is dangerous.

Oh, that sound you hear?
That's Sandmann's lawyer salivating - again.
After appearing at the Republican Convention, I think it could be argued the young man is now a public figure.
Absolutely crappy on the part of the ACLU, but probably judgement proof...

I wonder. What this asshat said is slanderous ("dangerous?") without any proof. I wonder...
A court just ruled that Palin's slander lawsuit against the New York Times can proceed, you know.

Actually, I hope so. Our slander and libel laws have become too lax, in regards to public figures.

It's not the ACLU, it's Samuel Crankshaw's personal opinion, see the Facebook post by Crankshaw where he prefaced his post with these words:
NOTE: These are my personal views that I am expressing on my personal Facebook page on my personal time. They do not necessarily reflect the views of my current or past employers. I have a First Amendment right to express my views just as Nick Sandmann has a First Amendment right to express his. I will continue to express my views on my personal time.

You're right. Thread title edited to reflect this.
Hopefully the ACLU will discipline this staffer who is publicly saying hateful things about teenagers. I mean, we've come to that, haven't we?

I was just going to make that point. WaPo tired to argue that he was a public figure but that logic was a bit circular - the act of slandering the non-public figure made him a public figure.
But after the brouhaha he was almost certainly a public figure. And definitely so after the convention.

Turley says that in the article I cited:
"While the statement is from someone who expressly identifies as an ACLU staffer on social media, it is not a statement from the group. Yet, the sentiment reflects the growing concern over the new direction of the ACLU and the shift away from neutrality in the support of free speech rights."

How many people have been fired from their employer for doing just this? The defense doesn’t pass the sniff test to inoculate his employer although it likely passes the legal test.

Which is what I said a few posts up, about the ACLU disciplining this guy. Actually, people have been fired for non-specific things they've said. This asshat calls out an individual.

Nah, this is small potato compared to Pompeo trying to get around the Hatch Act while speaking at the RNC by claiming that he spoke there as an individual rather than as an agent of the State Department. If Pompeo's claim passed the sniff test for you, you should have no issue with this one.

Nice whatabout fallacy.
