      I don’t know how the laws are written so I don’t know precisely what matters of law will be put to the court, but SCOTUS will be loathe to step into role of adjudicating the quality of the scientific evidence behind the procedures.

      I think legal liability has a better chance of returning us to sanity on this issue than the courts or legislatures do.

        The bigger question will be whether the SC will uphold the 6th Circuit’s opinion that Trans are not necessarily a suspect class under Equal Protection, as it’s not something that is immutable or ascertainable at the the time of birth.

        I think it’s probable that the Court upholds the ban but strikes the opinion re: suspect class. But if the court doesn’t strike that part of the opinion, then Hoo-Boy, all bets are off the table…

                Oh man, Barrett’s concurrence was devastating and opens all kinds of legal obstacles for the trans community claims of protected status… This will be worth watching.

                        She does lots of podcasts. Never dull. I liked her most famous book We Need To Talk About Kevin. I got it at an airport bookstore for a flight, thinking it was a thriller twisty page turner. Not quite.

                        Education is extremely important.
