I think the reason that the ERA failed was that it was assumed that women were at a disadvantage under the law.
Once everyone caught on that men were the ones at a disadvantage it became obvious that men could become equal. This could not be allowed.
Child custody is one example of this. Men get custody, less than 20% of the time.
