Musk even wrote in a post on X — formerly Twitter — that “US law requires at least a green card to be hired at SpaceX, as rockets are considered advanced weapons technology.”
Seems plausible to me. The US military certainly has similar restrictions.
EDIT: OK, just read the DOJ's complaint. Paragraphs 24-26 address that point, saying export control laws' definition for "US persons" include asylees and refugees.
