I just read another piece. He was driving a Porsche and tried to cross Hwy 29 in Napa late at night, causing a wreck. The piece by CBS went on to say she refused to comment on a private matter, then went into fawning praise for her speech at Brown.
I suspect the only reason he was charged was because there was a wreck.

Paul Pelosi, 82, was attempting to cross in Napa County’s State Route-29 in a 2021 Porsche late Saturday when he was in a collision with a 48-year-old man driving a 2014 Jeep, the California Highway Patrol said.
There were no reported injuries and the police report does not identify either driver as being at fault, CNN said.

That sentence is a numerologist's dream.

BAC was 0.082 when tested - two hours after the crash.
So at the time of the crash it was probably in the range of 0.11.
0.015 per hour is the rate of decline.

They can't walk backwards like that during court proceedings, though, can they?

Nope. BAC is when it is measured.
What they will most likely do, is attack the methodology of the test or how it was administered (if they fight it).
