That's pretty much element for element the definition of actual malice by reckless disregard for the truth: Saying something you have real subjective doubt is true.

Question for the True Believers out there: why would you make claims on your own podcast that you felt you had to actively discredit during a court hearing? What's the reasonable answer, beside Dominion = The Barge?

Because the defamation of Sandmann occurred in several news outlets, as opposed to one person making allegedly defamatory statements.

Because I really didn't follow Giuliani's statements about Dominion. Call me ignorant, if you wish, but I thought his comments, as little as I heard, were, well, unusual.

Go to court. Prove the allegations. Sandmann won settlements from some large outfits. either because the litigation would be too expensive, or it's a tacit admission of guilt. It'll be interesting to see what discovery will show in this case.

I think Giuliani's defense is weak. He made lots of allegations with, apparently, no basis in fact. Sandmann's case was bolstered by video, print, etc. Totally different.

And another thing. The fact that someone is silent on the issue doesn't necessarily mean they agree with the issue. That's presumptuous on your part. Silence is not assent, at least not on an internet forum.

I’m not sure I ever went on record supporting Giuliani. I think I said the opposite. If dominion has a case they should nail him to the wall for sure.
With CNN and others I could see for my very eyes exactly everything that happened. It was an open and shut case. Not so clear with Giuliani, yet.

Trump’s dream teamGiuliani, Lin Wood, and Powell.Six-two-and-even Trump will join them soon as a defendant.
Note that the Sandman case was also against media outlets and specific personalities. Though they were pundits, not lawyers.

It's not too surprising to me that lots of folk will be more motivated to speak out against the MSM and pop culture mob attempting to destroy an innocent young man's life in order to propagate their favorite narrative, than they would be to speak out against whatever it is that Giuliani said about this faceless corporation. But if the faceless corporation has a case, let them bring it. Maybe it will provide us more clarity about the foundations of whatever these claims of fraud were in the first place. Like the vast majority here, I didn't follow them closely and counted on the systems holding up.

On one side we have a frigging teenage boy who’s life was severely impacted and had his character trashed. He had “journalists” actually say they wanted to punch his teeth in.
On the other hand you have a multi-billion dollar business suing for another billion dollars over allegations that likely won’t cost them a dollar in business...

You have to quantify the monetary value of “life severely impacted, character trashed” to come up with negotiated or court awarded monetary compensations.
Similarly Dominion has to quantify and prove how many dollars the allegations cost them in businesses before they can get that judgement. Let them try to prove it and see what happens.
