Can he? Sure. Is it a good idea? He'd have to make an awfully strong case for why this is necessary at this time. Not sure he can do that.

His case during the briefing yesterday, was that no President before him had had this many nominees slow-walked and the lack of people in these jobs was hurting government response to the current situation and recovery.

Absolutely. It's not a new practice. It's just gotten worse. Some of Trump's appointments have been languishing for almost three and a half years.

I'm not sure he can or should build a specific enough case related to the pandemic to withstand court challenges. 'By any means necessary' thinking is what brought us FISA, Mueller and impeachment.
