I don't think it's entirely lawfare. They doctored the tape, that's well known and provable. They should have done a public mea culpa at the time and issued the transcript.
When you screw up that badly and will not admit it, do not be surprised if you get sued. By anybody.

Last I checked they had a first amendment right to say whatever the fuck they want. The suit is frivolous.
Settling is basically paying extortion to Trump to prevent him from blocking the paramount merger. Call it a bribe if you want.

Uh, no.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
However, the FCC does recognize this: As a result, broadcasters are only subject to enforcement if it can be proven that they have deliberately distorted a factual news report. Expressions of opinion or errors stemming from mistakes are not actionable. IOW, if a broadcaster distorts the news willingly, he is no longer covered by the First Amendment.
It is Trump's allegation that CBS willingly distorted the news in a POTUS campaign for political purposes. Does he have a case? Ask CBS... I think it is apparent they did not act in good faith.
