On election night, Miranda Yaver, an assistant professor of health policy and management at the University of Pittsburgh, posted on X, formerly Twitter, "Sotomayor should retire tomorrow and let the lame duck Senate confirm her replacement."
A lame-duck session refers to the final months of a president's term after the presidential successor is elected in November but before a new Congress convenes in early January. Biden leaves office on January 20, giving the administration just over two months to nominate and confirm a justice.
David Dayen, editor of The American Prospect echoed the same sentiments, writing on Wednesday, "This would probably be a good day for Sotomayor to retire."
The renewed push stems from concerns that Trump, elected as the next U.S. president on Wednesday, along with the newly Republican-majority Senate, could appoint a conservative-leaning justice, further tipping the Court to the right.
In April, calls circulated with several opinion pieces and posts urging Sotomayor to retire, including journalist Mehdi Hasan, who just reshared his article yesterday with the caption, "I happen to think this piece of mine aged (sadly!) pretty well."
In the piece, he notes what many Trump opponents fear: a repeat of what happened with Justice Ruth Bader Ginsburg, who died of pancreatic cancer at age 87, just weeks before President Biden won the 2020 election.

Speaking of retiring, here's some more fanciful thinking.
Biden will resign in the next few weeks, making Harris the President.
As such, she can implement a whole bunch of new policies, including a Supreme Court appointment. She will also, forever, and most importantly, hold the honorific of "President of the United States."
The fact that this is another post she wasn't elected to is just perfect.

The New York Times reported in 1993 that Thomas, who was appointed to the court in 1991, once told a clerk he intended to stay on the bench until 2034. “The liberals made my life miserable for 43 years,” Thomas, then 43, said at the time, “and I'm going to make their lives miserable for 43 years.”
regarding Sotomayer
The idea would be to avoid another Ginsburg by: 1) convincing Sotomayor to retire ASAP; and 2) replacing her with a younger liberal justice (possibly D.C. Circuit Judge J. Michelle Childs) while Biden is still president and Democrats continue to control the Senate during the coming lame-duck session.
It is unlikely, however, to succeed. With a 51–49 majority — which includes three independents — Democrats could spare only a single vote. And time is short. Any delay — which Republicans would try to force — could leave Sotomayor’s seat vacant until next year, at which point Trump would simply replace her with a conservative. Sotomayor probably won’t risk retiring under these circumstances.

If Manchin or Synema don’t go along, they are sunk. And Joe Manchin is on the record that he will not vote for any judicial candidates this year without some Republican support.

There is still a process… Even after Reid blew up the judicial filibuster. It would take 4-5 weeks just to put together the Judiciary Committee hearing. The hearing itself would take 1-2 weeks. Once it gets to the Senate as a whole, there is still going to need to be some debate time. Even with the Nuclear Option, the democrats will need 51 votes to close debate. They don’t have 51…
So please, convince Sonia to retire! That would be so wonderful!
