Is there nothing Biden can't do?

From the article:
...that will make it more difficult for companies to treat workers as independent contractors rather than employees that typically cost a company more
If the "independent contractors" and the "employees" do the same job or produce the same thing, why should one class be cheaper or more expensive than the other class? If they cost different now, the choices are down to bringing the higher cost category down to the same level as the lower cost category, or the other way round. Viewed from the labor force's perspective, it's either bringing the remunerations of one class up to the other, or the other way round.
Higher labor costs kill jobs? Gee, getting rid of slavery "killed" jobs too; doesn't mean slavery should be preserved as a practice.

Seems like there should be a common sense way to distinguish between true gig work and employers that just reclassify workers as contractors to avoid regulations.
We had to lay off an employee in 2019. We really wanted to keep her on as a contractor for a few months to finish a (part-time) task she was doing. California’s SB5 forbade it.
The funny thing, or not so funny, was SB5 was designed specifically to go after Uber and Lyft. Yet they managed to lobby in an exception during the legislative process. So Uber kept being Uber, but the Foundation couldn’t pay a willing person to do some valuable work for a good cause.
Yay, government.
