      Interesting. This isn't the final word in this case (which is really about off-label use). All that happened is that the 5th circuit allowed the lawsuit to proceed.

      The docs claim damage because FDA crossed the line (as the court said) between telling about and telling to.

      But was there harm caused to the docs? Yes, loss of privileges, academic positions and investigations of licensure.
