      If he HAD to squeeze off a couple rounds, they should have been warning shots way over anyone's head. This carries castle doctrine a bit too far. I believe in the right to bear arms, but also the responsibility to use them properly. This does not appear to meet that standard.

        I think that's why he's charged with what he's charged with...Teenagers (this wasn't small children) are rummaging around his home and the property next to his. He doesn't know who or what they are and is fearful.

        When he grabs his gun and steps out, they run. If they run towards him, Castle Doctrine applies. But they ran away. At that point, things get murky. Castle Doctrine does have an Imminent Danger component.

        Since he fired his weapon at them, the Aggravated Assault charge will stick. That's a felony.

        But...Owing to the fact it was dark and there was something happening outside his home, it's not attempted manslaughter or attempted murder.

        Unless he has a criminal record, he's not going to Angola and maybe not a max security state prison.

          They were playing hide and seek? Okay, I understand the fear factor on the part of the guy, but what kid hasn't played hide and seek and gone outside their property lines? We used to do it all the time as kids.

            We had something similar happen here at Bengals running back Joe Mixon's house. His sister's boyfriend shot a kid who was playing Nerf wars with other teens. But at least there had been death threats, or so she said.

              They were playing hide and seek? Okay, I understand the fear factor on the part of the guy, but what kid hasn't played hide and seek and gone outside their property lines? We used to do it all the time as kids.

              I almost shot a kid several years ago. A group of teenage boys was having a paintgun war on my place. Naturally, i get in the truck and go to see what all the hooping and hollering was about, and right at dark-thirty, a guy comes out of the woods with a (paint) gun in his hands.

              I was thumbing the safety off my pump, when I saw the gun looked funny and the guy had on goggles. But if that kid had pointed that paint gun at me, I'd have shot him right there on the side of the woods.

                    Hmmm. 14 years old. Grade 7 or 8 or 9. When I was that age, still did that. I know in the US, there is a game like hide and seek called "ghosts in the graveyard" that is only played in the night. Similar game in Taiwan. Doing it at night was the whole point of it and added fun.

                    I do not think that the kids behavior was unusual. Maybe it was not the smartest thing, but I would say that it is pretty common.
