First Amendment protection for speech that "encourages illegal immigration"?

There is a law on the book that bars inducing or encouraging noncitizens “to come to, enter, or reside” in the United States illegally. Some one who promoted some harebrained illegal immigration scheme to Mexicans was convicted of that offense. He sued and had an appeals court declaring the law unconstitutional on the grounds that the law violates the First Amendment. The Biden administration appealed, and now it's in SCOTUS.
