According to the FISA Rules and Regs ..... There is only one person that can order "Electronic Surveillance" without a warrant ..... As stated .... "...
The President may authorize, through the Attorney General, electronic surveillance without a court order for the period of one year."He's by no means off the hook.

Unless, as McCarthy wrote a few days ago, there was a "friendly nation" which did the surveillance, with a "wink and a nod" from the US.
