      ABC was just talking about this, saying it was unnecessary because the PA SecState had already instructed them to do so. BUT - it wasn't binding.

        Yes, from what I have read, the late arriving ballots have not been included in any count yet.

        VP Biden is ahead even without these ballots.

          Biden wins without these.

          But I hope they move forward because I would love to see it resolved. I think there’s almost no chance that Scotus would invalidate honest, well-intentioned votes submitted under the rules that were advertised by state election officials.

          If they rule for the PA legislature, the remedy would be entirely forward looking.

          And it will be a thing of beauty to watch most or all of Trump’s Scotus picks rule that the existing ballots be counted.

          Especially invoking the lesser-known ruling in Bush v Gore to do it.

            Not sure this is the right place, but it's the closest I could find, and it sort of ties in to Jon's point above. From Politico:

              This ain't going away.

              Interesting point...If SCOTUS rules the Pennsylvania governor exceeded his authority in changing election rules, then that ruling would apply to every governor who changed the rules.

              How much of this election would this invalidate?
