Considering his space business is inextricably linked to government approval and support, I'd say his perception here is way, way off.

What? SpaceX is going to adhere to California law on Mars because SpaceX as a corporate entity is domiciled in California?
It may not look like it now, but a Chinese company may also send spaceships to Mars, they may extend Chinese Communist Party rules to Mars and you will be okay with that?
No nation state is going to acknowledge unilateral imposition of any one nation state’s laws on Mars at this point, and the United Nations will not reach consensus on a legal framework for Mars anytime soon. Leaving it open ended for now is the only practical way forward, for now.

We are a hundred years from this making any damn difference because there won't be enough people there to create a conflict, and I cannot imagine we need the EPA to protect the Martian environment. The only way legal issues will be relevant is in the origins and nature of missions, and that will all be about Earth, not Mars.

Thus, at least according to James I's writ, the Virginia Colony in its original sense extended to the coast of the Pacific Ocean, in what is now California, with all the states in between (Kentucky, Missouri, Colorado, Utah, etc.) belonging to Virginia.
