It can be done via legislation. But, requires both houses of Congress and the President. Fundamentally, it's no different than any other law.
But the fact that Biden won't answer the question (and neither will Harris) is telling. By not answering, they are answering, and from what I gather it's a very unpopular position.

Also seems like a bit of a red herring. They’d need a big majority to get 50 I think. Not every Senator wants to go there.

Let me say I actually assume he’s still against it, like he was during the priamry. But he doesn’t want to alienate the left especially as they’ll be wound up by the ACB hearings.

That wasn't my point. The point was to make the joke a bit more subtle. However, I guess they needed something those a little slower on the uptake could figure out.
