Apparently a NY judge dropped the terrorism charge saying prosecutors hadn’t presented enough evidence.
That’s just the state charge. Federally is where he could get the death penalty and I don’t think the federal murder charge is dependent on a terrorism charge. Rather it was something about interstate travel for a gun crime, IIRC.

It also dropped his NY Murder 1 charge to a Murder 2.

Same. I have no idea how they drop an obviously planned and intended murder to murder 2.
Murder 1 in NY needs to either be terror related OR the victim was a firefighter, police officer, witness to a crime OR multiple victims OR it occurred during the process of a 2nd felony OR it was a murder for hire OR the defendant is a repeat offender.
