Now let's see them scramble to refile somehow.

Trump’s efforts to dismiss the case under the appointments clause was seen as a long shot, as several special counsels – even during his own presidential administration – were run the same way.

        and

...but the answers are not entirely self-evident, and the caselaw is not well developed.”

She noted in her ruling that Smith’s team “suggested” at a court hearing on the matter that they could restructure the office’s funding to satisfy her concerns.

I think that they will appeal the ruling. (Assuming that they can). Even if they do, nothing will happen before the election.

And if that is the case, however the election turns out this matter will vanish like a fart in the wind.

            Appeal rather than refile.

Heard Turley go through this one...He said this wasn't just pulled out of the blue, but is an issue that has seriously been debated among legal scholars for years.

He also said the judge had honed in on $12M in funding, asking Smith where his money was coming from, since it was not authorized funding from Congress.

Regardless, Smith had signaled he was going to fight this case up until January 20th, regardless of election outcome.. Turley said he can forget doing that now, as this ruling pushes the case even further out.

Does the appointment of Weiss fail under this ruling?
