Turley’s point about the earlier cases being decided on Freedom of Religion when they should have been decided on on Freedom of Speech is a good one. And it does make a difference…

I thought so, too, and I agree about the whole Freedom of Speech point, but I don’t think he finishes the idea. If you win on a Freedom of Speech argument, you now call into question the Constitutionality of ALL of the protected classes. Laws protecting people on the basis of sex and race will now now become invalid without an appropriate amendment.

I’m not in favor of businesses being compelled to transact against their will for whatever reason. One of the biggest reasons I went independent was the ability to say no to business I did not think was good for me or good for the client, or even if I did not like the people involved. I gave up six figure pieces of businesses because I did not think what they wanted was either possible or a good idea. I don’t think these cases are really any different.
