I thought the same thing, but...
He disarmed the robber, so presumably, the robber was no longer a threat to life. I guess that's what Bragg is hanging his hat on.

The charges were dropped several hours ago, and considering the attendant was shot twice, he was still at risk.

Have you seen anything saying the thief had given up or wasn’t struggling? I haven’t. The implication is that the two were wrestling, he got shot twice, then managed to turn the gun on the other guy, but they were still struggling…
