    The judge is ruling on the 2019 "heartbeat" law saying that, at the time it was passed, it was unconstitutional, because Roe.

    McBurney said the state would have to pass the law again now that the Supreme Court has overturned Roe for the ban to be valid. The 2019 law was "plainly unconstitutional when drafted, voted upon, and enacted," McBurney wrote in his opinion.

    But now, Roe is overturned. Does that make his judgment invalid?

      Segregated school laws were ok before Brown v. the board

      Were they grandfathered in like this?

          Not enough detail in the story. Was it struck down at the time? Or just effectively dormant because they never bothered enforcing it? If the former, it doesn’t automatically become law, they would need to pass it again. If the latter, it’s fine and he’ll be overruled.

            If it was a trigger law going into effect iff the Supreme Court overruled roe, then he’s also wrong and will get overruled.
