                  The American Civil Liberties Union (ACLU) and other groups sent a letter to the Biden administration earlier this week, pushing back against a potential ban on menthol cigarettes. The groups said that such a move would “Disproportionately Impact People and Communities of Color, Trigger Criminal Penalties, and Lead to Negative Interactions with Law Enforcement.” The letter pointed to the cases of Eric Garner, Michael Brown, and George Floyd as situations where cigarettes were involved, adding that “well-intentioned efforts to continue to reduce death and disease from tobacco products must avoid solutions that will create yet another reason for armed police to engage citizens on the street based on pretext or conduct that does not pose a threat to public safety.” The groups argued that a ban on menthol cigarettes “would disproportionately impact communities of color, result in criminalization of the market, and exacerbate mass incarceration.”

                  According to the FDA, “Menthol is a flavor additive with a minty taste and aroma that is widely used in consumer and medicinal products due to its reported cooling or painkilling properties.” When it is put into cigarettes, menthol can lessen the irritation that comes from smoking, but the agency says that some research suggests cigarettes containing menthol might be harder to quit than regular cigarettes, “particularly among African American smokers.”

                  The FDA stated that over 19.5 million people in the United States currently smoke menthol cigarettes. 85.8% of African American smokers smoke menthol cigarettes, whereas 46% of Hispanic smokers, 39% of Asian smokers, and 28.7% of white smokers use them. Menthol cigarettes are also reportedly more popular among young smokers. The FDA noted that over half of smokers between the ages of 12 and 17 smoke menthols.

                          When I was growing up the conventional wisdom was that they were more dangerous but obviously I wasn’t reading any studies.

                          They could be doing this as a health equity thing, who knows.

                          They’ll end up, after a lot of drama, with the same formula they use every time they have a trifecta: take away health care and food assistance from low income families and use the money to fund tax cuts for their donors.

                              Biden Administration Shelves Plan to Ban Menthol Cigarettes

                              The Biden administration is reversing course on its plan to ban menthol cigarettes, after the White House weighed the potential public-health benefits of banning minty smokes against the political risk of angering some Black voters in an election year.

                              The administration said Friday that it is delaying a decision on whether to impose a ban, contending that it needs more time to consult with outside groups on the matter. There is no timeline for the administration to revisit the decision, as President Biden competes with former President Donald Trump for votes in November.

                              Menthols account for more than a third of all cigarettes sold in the U.S. each year and are predominantly used by Black and Hispanic smokers. Some 81% of Black smokers used menthols in 2020, compared with 30% of white smokers and 51% of Hispanic smokers, according to a Wall Street Journal analysis of data from the National Survey on Drug Use and Health.

                              Some Black community leaders had fought the measure, saying a ban would expand the illicit market for cigarettes and lead police to racially profile Black smokers. The American Civil Liberties Union and some members of the Congressional Black Caucus expressed similar concerns.

                              The proposed ban has generated much feedback from the civil rights and criminal justice movements, said Xavier Becerra, secretary of the Department of Health and Human Services. “It’s clear that there are still more conversations to have, and that will take significantly more time,” he said in a statement.

                              The Biden administration in 2021 began pursuing a ban on menthol cigarettes, saying the policy move would reduce youth initiation, increase the success rate for smokers trying to quit and address health disparities among people of color. The plan was part of the administration’s Cancer Moonshot initiative to reduce the death rate from cancer.

                              The Food and Drug Administration had been expected to adopt a new rule banning menthols last year, but the plan was delayed as the White House mulled its political repercussions.

                              Menthols, afaik, aren't more dangerous than regular smokes.

                                Stupid idea anyway. If you're going to do anything just ban them all. Then soft drinks, fast food, lard, etc.

                                  When I was in school only a few girls and nerdy guys who wanted to be cool but really weren’t or even could be cool,
                                  smoked menthol cigarettes. Those and few of our mothers.

                                  Should have been banned for being an abomination of a vegetable supplement even back in those days. Vile.

                                      Once when I had caught a cold I bought a pack of menthols. The vile taste made me cough even more. Pretty sure I gave the nearly full pack to my mother.
