      Sure they’re the same if you abstract it enough. But the acceptance within the culture is nowhere near the same. Some of us might find it more compelling to speak out against the antisocial behavior that is more widely accepted and even encouraged.

                    How about our resident Insurrection Buffs?

                    Loki, Jon, Aqua...How do you feel about unlawful parading charges? And what are your thoughts on trying to stick to those charges vs. dropping charges or pleading down for other people who tried to burn down a Federal courthouse?

                    Lastly, do you think that it is unreasonable to jail people in solitary confinement for seven months, denying them bail and due process, for misdemeanor charges?

                    I've been frustrated about the light handedness but then I heard Ken White (popehat) talk about the reasoning. The DOJ has many hundreds of these assclowns to deal with and simply can't take them all to trial. So each of them are getting much lower charges and sentence offers than they would if there were, say, 10 of them. That makes perfect sense, but it's frustrating as hell. I do worry about the lack of deterrent. For many of these guys their little misdemeanor and fine will be a badge of honor.

                    Regarding the heavy handedness of the pretrial bit, I'm not too worried about it because these guys aren't getting these light charges because that's what they deserve, they're getting them because there were so fucking many of them.

                    Only non-witches get due process.

                      That's the DOJ's problem. They're arresting people for walking through the building, when if they need to be charging for more serious crimes, they should be concentrating on those.

                        There are people locked in solitary confinement in a jail cell in D.C. for over seven months, no bail, with their only charges being misdemeanors.

                        Both wrong and needs to be remedied. Charge them and try them promptly, or let them go free.

                                  “No wonder parts of the public in the U.S. are confused about whether what happened on January 6 at the Capitol was simply a petty offense of trespassing with some disorderliness, or shocking criminal conduct that represented a grave threat to our democratic norms,” Judge Beryl A. Howell said in court Thursday. “Let me make my view clear: The rioters were not mere protesters.”

                                  While she and other judges have expressed similar concerns before, this was Howell’s first time sentencing a rioter and her first chance to fully air her views and demand answers from prosecutors. She took the opportunity, spending over an hour interrogating prosecutors on the decision to let Tennessee video game developer Jack Jesse Griffith plead guilty to the misdemeanor of parading inside the Capitol.

                                  Why, she asked, when prosecutors called the riot an “attack on democracy . . . unparalleled in American history,” were Griffith and other participants facing the same charge as nonviolent protesters who routinely disrupt congressional hearings?

                                  “It seems like a bit of a disconnect,” Howell said — “muddled”
                                  and “almost schizophrenic.”

                                  The parading charge carries a sentence of at most six months, with no supervised release.

                                  “Is it the government’s view that the members of the mob that engaged in the Capitol attack on January 6 were simply trespassers?” Howell asked incredulously. “Is general deterrence going to be served by letting rioters who broke into the Capitol, overran the police . . . broke into the building through windows and doors . . . resolve their criminal liability through petty offense pleas?”

                                  After asking for probationary sentences in several cases, the government sought a three-month jail sentence for Griffith. Howell questioned what distinguished those cases from this one. Assistant U.S. Attorney Mitra Jafary-Hariri said prosecutors gave some defendants credit for early acceptance of responsibility.
