For Khanna's suggestion to work, the law would have to be changed first.

Wouldn't it be fun to watch a GOP majority enact this law and push for more SCOTUS seats?

OTOH, it might be just as much fun for a Democrat majority House (and Senate) enact this law and watch Trump veto it?
